Retired workers whose Social Security checks were reduced by the Windfall Elimination Provision (WEP) are now receiving increased benefits thanks to the Social Security Fairness Act. The act, which went into effect in May 2025, eliminates both the WEP and the Government Pension Offset (GPO). These provisions had previously reduced Social Security payments for those who also received a pension from non-covered government employment, such as teachers, firefighters, or police officers.

As of January 2024, these reductions no longer apply, allowing affected retirees to receive their full benefits. In addition to retired workers, the act also benefits workers with disabilities affected by the WEP, spouses whose benefits were reduced or eliminated by the GPO, and surviving spouses whose Social Security was cut or denied due to the GPO. Retirees who delayed their application because they knew the WEP or GPO would reduce their benefits also see increased payments.

Since the law was passed, the Social Security Administration (SSA) has received more than 182,000 new applications and has already processed 85% of them.

Social Security increases for retirees

If you are already receiving Social Security benefits and were affected by the WEP or GPO, you do not need to take any action if your mailing address and bank information are up to date.

However, if you never applied for benefits due to expected reductions from the WEP or GPO, you should apply now to start receiving them. The date you apply will determine when your benefits begin and how much you will receive, so it’s important not to wait. To apply online, visit ssa.gov/apply.

If you are applying for survivor benefits, call the SSA, as that form is unavailable online. To ensure your information is correct, log in to your My Social Security account or call 1-800-772-1213. The Social Security Fairness Act is a significant development for thousands of retirees nationwide who now receive the benefits they deserve.

Stay informed and ensure you are receiving the benefits you are entitled to under this new law.
